General terms and conditions
This text is a translation of the Dutch original. In the event of any difference or dispute over interpretation, the Dutch text prevails.
1. GENERAL
These general terms and conditions apply to lessons, courses, workshops, performances, events and other services offered by The Saz Academy.
By completing an enrolment, the student or, in the case of a minor, his or her parent or legal representative declares that he or she has taken note of these general terms and conditions and agrees to them.
In these terms and conditions, studentalso means the parent or legal representative where the student is a minor.
2. Enrolment
An enrolment is made using The Saz Academy’s enrolment form or in another manner accepted by The Saz Academy.
The student is responsible for providing the requested details correctly and in full.
The final placement of a student, including lesson day, lesson time, teacher and, where applicable, group level, is determined in consultation and is subject to availability.
A free trial lesson does not automatically give entitlement to a permanent lesson place.
3. Students who are minors
For students who are minors, the contact details of a parent or legal representative may be requested.
The parent or legal representative is responsible for arrangements made on behalf of the minor student and, in so far as applicable, for payment of the lesson fees due.
4. Lessons offered
The Saz Academy offers, among other things, group lessons, private lessons and other music education activities.
The current range of lessons, the rates, the lesson duration and any packages are stated on the website or agreed separately with the student.
The choice of a specific type of lesson or the level may be settled in consultation with the teacher.
5. Lesson scheduling
The lesson day and lesson time are determined in consultation.
Where this is reasonably necessary, The Saz Academy may make changes to the schedule, teacher, lesson room or group allocation. A change will be communicated as soon as possible.
Where a structural change is not reasonably acceptable to the student, The Saz Academy and the student will first look for a suitable solution.
6. Absence of the student
Where a student is unable to attend, this is to be reported to The Saz Academy or the teacher as early as possible.
A group lesson missed as a result of the student’s absence does not, in principle, give entitlement to a refund or a replacement lesson.
For private lessons, separate arrangements may apply regarding timely notice of absence and the possible rescheduling of a lesson. These arrangements are made known with the type of lesson concerned or agreed with the student.
7. Cancellation by The Saz Academy
Where a scheduled lesson cannot be given by The Saz Academy or the teacher, The Saz Academy will, where reasonably possible, try to offer a replacement lesson, a replacement teacher or another suitable solution.
Where a paid lesson is definitively not provided and no suitable replacement is offered, this will be taken into account in the financial settlement in so far as the student is entitled to this by law or under the contract.
8. Rates and payment
The price applicable to the chosen type of lesson is made known before the agreement is entered into.
Unless stated otherwise, the prices stated on the website for consumers include applicable VAT (btw).
Payment is made in accordance with the chosen or agreed method of payment.
Where payment in instalments has been agreed, the payment obligation continues for the agreed term, subject to the student’s statutory rights and any different arrangements made with The Saz Academy.
In the event of payment arrears, The Saz Academy may take further measures after having informed the student of this and with due observance of the applicable statutory rules.
9. Term and cancellation
The term of the agreement and any minimum purchase period are made known before or at the time of enrolment.
Where an agreement continues for an indefinite period after a fixed term, the consumer may thereafter cancel it with due observance of the notice period permitted by law.
Notice of cancellation may in any event be given to The Saz Academy in writing or by e-mail. Where the agreement was entered into online, it must also be possible to cancel it online.
During an agreed fixed term, the arrangements made continue, in principle, to apply, subject to statutory rights and any exceptions agreed in writing.
For consumers, a notice period of no more than one month applies after a renewal in the case of many subscriptions. For that reason we are deliberately not laying down a longer period here.
10. Holidays and lesson-free periods
Lessons are given in accordance with The Saz Academy’s schedule.
During announced holidays, public holidays or other lesson-free periods communicated in advance, lessons may not take place.
Where an annual or periodic rate is applied, such lesson-free periods announced in advance may already have been factored into the structure of the rate and the number of lessons offered.
11. Conduct and safety
Students are expected to treat teachers, other students, visitors, instruments, equipment and locations with respect.
Conduct that seriously or repeatedly disrupts safety, order or the teaching process may be grounds for taking appropriate measures.
In serious situations, The Saz Academy will, in so far as reasonable, first contact the student or, in the case of a minor, his or her parent or legal representative.
12. Belongings and instruments
Students themselves remain responsible for their personal belongings and instruments.
The Saz Academy is not liable for loss of, theft of or damage to personal belongings, except in so far as the damage can be attributed to The Saz Academy under the law.
13. Liability
The Saz Academy performs its services with reasonable care.
The Saz Academy is liable for damage in so far as it can be attributed to The Saz Academy under the applicable legislation.
Nothing in these general terms and conditions is intended to exclude or limit statutory liability in so far as such an exclusion or limitation is not permitted.
14. Photographs, video and sound recordings
During lessons, performances, events and productions of The Saz Academy, photographs, video recordings and sound recordings may be made.
Recognisable image and sound material may, where there is a valid legal basis for doing so, be used for, among other things, reporting, communication, the website, social media, promotional material and audiovisual productions of The Saz Academy.
Where consent is required, it will be requested separately.
Consent that has been given may be withdrawn for future use. A withdrawal does not have retroactive effect with regard to processing that lawfully took place before the withdrawal.
The Saz Academy cannot guarantee that material which was lawfully made public before a withdrawal and has subsequently been shared, copied or distributed by third parties can be removed everywhere from external platforms or systems.
15. Productions, performances and events
Participation in a performance, recording or other production may entail additional practical arrangements.
Where participation is voluntary, this will be made clear in advance.
For larger productions, additional arrangements may be made regarding rehearsals, scheduling, clothing, location, recordings and the use of material produced.
Such additional arrangements, where they have been agreed in advance, form part of the arrangements relating to the production concerned.
16. Personal data
The Saz Academy processes personal data in so far as this is necessary for, among other things, enrolment, administration, communication, scheduling, the provision of lessons and compliance with statutory obligations.
Personal data are processed in accordance with the applicable privacy legislation.
Where consent is required for a specific processing operation, it will be requested separately.
Further information on the processing of personal data is set out in The Saz Academy’s privacy statement.
17. Changes to rates or terms and conditions
The Saz Academy may change rates and general terms and conditions where there is reasonable cause to do so and in so far as this is permitted by law.
Changes that apply to an existing agreement will be notified to the student concerned in good time where this is required by law or under the contract.
A change does not limit the consumer’s statutory rights.
We are deliberately wording this with restraint: a trader cannot simply change existing consumer terms and conditions without limit during the term of the agreement. Requirements apply to this, including prior arrangements, reasonableness and communication.
18. Complaints
A complaint may be reported via:
The Saz Academy tries to handle complaints with care and within a reasonable period and, where possible, first looks for a suitable solution together with the student.
19. Applicable law
Agreements with The Saz Academy are governed by Dutch law, in so far as this is permitted by law.
Disputes are preferably first resolved by mutual consultation.
Where a dispute cannot be resolved between the parties, it may be submitted to the court that has jurisdiction under the law.
